2nd Letter to A.G. Garland -- Big Action Soon

Important Introduction: This is a strong letter*though diplomatically
worded. It respectfully asks A.G. Garland to 1) apologize to our community for the repeated wrong doings of FBI agents against persons of Chinese heritage. 2) fire the wrongful agent(s) , and 3) promise us that this kind of wrongful acts will not happen again. If ignored, 80-20 shall take resolute action.

Read this letter very carefully with your best thinking-cap on, especially its 3rd-to-last and 2nd-to-last paragraphs. You need

  (A) to be aware that BIG ACTION(S) may occur this month, since the 2-
        month period that we respectfully provided the A.G. to reply has passed,
  (B) to witness a video in which FBI Director Wray 1) humbly apologized to the
        gymnast community, 2) fired the FBI agent who wronged the gymnasts,
        and 3) promised to "never let it happen again", and
  (C) to ask yourselves if we deserve the same apology, the same firing of the
        wrongful agent(s), and the same promise that "it'll never happen again"?
        If we are not accorded the same judicious treatment, We ARE BEING
        TREATED AS SECOND-CLASS CITIZENS.
  (D) to pay attention to diplomatic language like "at this time" to appreciate
        how much the leaders of 80-20 have stuck their necks out to fight for our
        shared rights and honor.

      Finally, please search your soul if you want to demonstrate your support for 80-20 in this upcoming BIG STRUGGLE FOR EQUAL JUSTICE. Think about how your offspring will be treated, if you don't fight with 80-02 till victory!

*DOJ acknowledged the receipt of this letter on Nov. 9, 2021. 80-20 didn't release the contents of this letter until now, because we wanted to give quiet-and-reasoned-discourse a trial.

Dear Attorney General Garland:
 
        My name is S. B. Woo, former Lieutenant Governor of DE (1985-89) and currently the president of 80-20 National Asian American Educational Foundation.
 
       I write to ask you to protect the human rights of persons of Chinese descent in the U.S., which have been repeatedly and grossly violated by FBI agents in well-reported cases involving Sherry Chen (2012), Prof. Xiaoxing Xi (2015) and Prof. Anming Hu (2020).
 
        The case of U.S. v. Anming Hu, no. 3:20-CR-00021, was particularly illustrative. The following are the exact quotes about the gross misconduct of FBI agent Kujtim Sadiku, reported by a 6/10/21 Knox News article. Hu was accused by DOJ of being a spy for China.
 
       "FBI Agent Kujtim Sadiku admitted last week in an ongoing trial in Knoxville that federal agents:
 
  • Falsely accused former UTK associate professor Dr. Anming Hu of being a Chinese spy
  • Falsely implicated him as an operative for the Chinese military in meetings with Hu’s bosses
  • Used false information to put Hu on the federal no-fly list
  • Spurred U.S. customs agents to seize Hu’s computer and phone and spread word throughout the international research community that HU was poison
  • Used false information to justify putting a team of agents to spy on Hu and his son, a freshman at UTK, for nearly two years.
  • Used false information to press Hu to become a spy for the U.S. government.”
 
        In spite of the gross misconduct of your agents, which is publicly reported, and a deadlocked jury in the first trial, DOJ insisted on having Prof. Hu tried again.
 
However, the U.S. District Court judge, citing lack of evidence, acquitted Hu on all 3 charges. The above was an extremely rare judgment because the judge was required to view the evidence in the light most favorable to the prosecution. The Chinese-American community was relieved by the judgment but remains deeply concerned and worried.
 
         We asked, why wasn't agent Kujtim Sadiku fired? Seeing no action from you, a speculation rose that DOJ may be intentionally stimulating the wrongful arrests and prosecutions against persons of Chinese descent. The purpose is to create a chilling effect on every person of Chinese origin residing in the U.S.. Is the FBI emulating the tactics of totalitarian governments? Is the DOJ induced chilling effect on our small and vulnerable minority community a violation of our human rights?
 
There are also intemperate talks of raising our human rights grievances with the outside world, since our grievance filed within, i.e. with you (my letter to you on June 24, 2021, together with letters sent by Senators Chris Coons, Tom Carper and Tammy Duckworth around the same time) and FBI Director Wray (my letter to him on 10/02/21) don't get answered. Some impatient people even suggest that we organize to make a big appeal to the United Nations in NYC. Others advocate that we advertise our plight worldwide, in Hong Kong, Taiwan and other places.
 
We are well aware of Director Wray's apology & promise to the gymnast community at the Senate Hearing on Sept. 15, 2021, for the FBI's failure to timely prevent the sexual abuse of gymnasts:
 
“….  I am deeply and profoundly sorry .... I'm sorry ....
I am sorry ....I am especially sorry ... that never should
have happened & we are doing everything in our power
that it never happens again .... the kinds of fundamental
error should never have happened, period! .... Never.
happens again. "
 
“… the Supervisory Special Agent in Indianapolis ... that
individual no longer works for the FBI in any capacity
people who engage in that kind of gross misconduct
have no place in the FBI …"
 
          Are the 5 million Chinese Americans just as worthy of a similar apology and promise by you and Director Wray? Shouldn't agent Kujtim Sadiku be fired?
 
          We, the Chinese American community, decidedly reject the idea of going outside at this time. We much prefer to hear from INSIDE! May we get a similarly clear statement from you and Director Wray so that such devastating tragedies, like those having befallen Sherry Chen (2012), Prof. Xiaoxing Xi (2015) and Prof. Anming Hu (2020), should never happen again and that agent Kujtim Sadiku has been fired?
 
         We'd like to hear from you in 2 months so that our planned national appeal for our human rights, as persons of Chinese descent, can be cancelled. If 3 months have passed and you still deem that our requests to you should not be honored, would you schedule a meeting with us to explain your rationale?
 
         We feel strongly that while America proclaims to the world the importance of human rights, the human rights of persons of Chinese descent in the U.S. are frequently and severely trampled upon. We seek prompt and certain relief.

80-20's UNIQUE position in "China Initiatve"

80-20's Reasoned & Unique Position On "China Initiative"

Q1: What is "China Initiative"?
A: Click here to read DOJ's official definition of China Initiative. It has 10    
components.


Q2: 80-20 has NOT joined the call to terminate "China Initiative", why?
A: 80-20 does NOT object to the rationale behind the existence of "China Initiative". Such a project is, unfortunately, an unavoidable consequence of a bad U.S.-China relationship. To illustrate this trend, 2 months ago CIA established a "China Mission Centre." Our National Security Council has a Senior Director for China in Jon Czin who was 1 of Biden's 6 staff in his virtual meeting with Pres. Xi of China. To ask DOJ to terminate China Initiative is politically unrealistic.

Even if one were to succeed in "terminating" it, such a project will exist underground. Our community will suffer more, because a covert program has NO transparency & accountability!

However, DOJ has grossly violated the human rights of the 5 million persons of Chinese descent in the U.S. in its EXECUTION of "China Initiative", as is documented in Q4. We must strenuously fight against such violation.

Q3: Isn't there a racial profiling issue in the "China Initiative"?
A: NO. If DOJ were investigating illegal transfer of technology to France, and
it focuses on Chinese, that is racial profiling. For DOJ to pay more attention to the Chinese community in its execution of "China Initiative," it is only common sense.


Q4: Are there evidence of DOJ violating our human rights?
A: Yes. First, I'll provide anecdotal evidence, and then statistical evidence.

(1) Anecdotal Evidence
The FBI has long engaged in the non-physical but extremely punishing torture of INNOCENT individuals of Chinese descent. FBI agents had lied, cheated & made incredibly stupid mistakes to incriminate our innocent individuals through the legal grinds of arrest, indictment, and court trials.

Examples are the well-publicized cases of Sherry Chen (2012), Prof. Xiaoxing 
Xi (2015) and Prof. Anming Hu (2020). The terror & plight brought to these INNOCENT individuals and their families have created a terrifying Chilling Effect on our community.

(2) Statistical Evidence
       (a) In a joint research project conducted by C-100 & the Univ. of Arizona, it is found
      that 50.7% of scientists of Chinese descent feel considerable fear and/or anxiety that
      they are being surveilled by the U.S. government, compared to only 11.7% of        
      scientists of non-Chinese descent.

         (b) Normally less than 5% of Asian Americans would donate anonymously.  To verify,
       click on http://www.80-20ef.org/SELF_results.html, which shows names of 2600
      donors. However, more than 50% of the 995 donors to Prof. Anming Hu's family to
       help them buy food chose anonymity! Why? Likely, the donors feared that the U.S.
       government might not approve of their donations.  How sad for our government!
       While advocating "human rights" worldwide, it scared its own people to such an
       extent.
         

Q5: DOJ worried about "non-traditional collectors" for China, is that why it is creating the Chilling Effect to scare the hack out of the Chinese community?
A: Yes, that is our guess. FBI director Wray has a preference for using totalitarian methodology. He advocated repeatedly in his Senate testimonies that we need to use "whole-of-society response" to catch Chinese spies - a not-so- subtle hint that there are Chinese spies everywhere in the U.S.

Could Director Wray be correct? NO! FBI's own record has clearly disproved the above myth. After a 3-year effort under China Initiative, DOJ
has gotten less than 10 convictions on individuals of Chinese descent. Hence the ratio of bad folks in our community is NOT 1 in 10 or 100 or 1,000. It is 1 in 500,000 in a community of 5 million.

DOJ needs to drastically revise its "China Initiative" playbook in order to stop the gross misconducts against the Chinese community in the EXECUTION of its China Initiative.

We, Board Members of 80-20, Are Grateful to You!

      At year's end, we count our blessings. Foremost on our list is your great support. We thank you for having done your share to help AsAms achieve
equal opportunity, and win equal justice and rights.
     
      As we review our year of 2021, we recall your

      1. helping Prof. Anming Hu and his family beat the wrongful accusation by FBI against him. You also helped get his job back from the Univ. of TN (although he still has some work visa problems which 80-20 and others are still helping). During his jobless days while facing a court trial, 80-20 helped his family raise at least $40,000 for legal and other expenses. We together demonstrated not only our warm heart to help a fellow AsAm fallen on tough times but also our iron will to beat injustice;

       2. helping spread the message of the proper way to participate in electoral politics, using Michelle Wu's successful run for the Mayor of Boston as an example. You helped to correct a weird trend in the AsAm community in the last 2 years - a person running for very high political offices, without proper preparation, and yet getting huge support from our community. This person gave our young people the wrong idea about how to participate in electoral politics;

      3. helping to ask Sen. Marsha Blackburn of TN to take down her tweet: "China has a 5000 year history of cheating and stealing" and apologize. Literally, thousands of you have called, emailed and faxed her. Many more
co-signed a full-page ad, published in 5 of the largest newspapers in TN asking Blackburn to retract her tweet & apologize. She has NOT. We'll try to punish this shamelessly ignorant person in 2024, when she seeks re-election; and

      4helping 80-20 Initiative grow. Without YOU, 80-20 couldn't possibly have gathered a war chest of $5.7 million to fight for AsAm rights. American Politics is Rough and Tumble

     What counts in American politics is CLOUT - the ability to affect the outcome of an important election or a piece of critical legislation.

     Without clout, our equal opportunity in college admissions & in job advancement, can be denied. Even our rights, to remain innocent unless proven guilty, can be violated. Remember the arrest, indictment, and terrifying legal grinds suffered by Sherry Chen (2012), Prof. Xiaoxing Xi (2015) and Prof. Anming Hu (2020)?

Led by 80-20 (All data from New York Times’ Exit Polls)  
 
     See how much difference 80-20’s 3 kinds of endorsements makes for a presidential candidate: endorse, or endorse with reservation, or no endorsement at all! Each point in the rightmost column means 60,000 Asian American votes in the 2020 presidential election.
     Professional politicians ("pols" from here on) used to think that the above table didn’t show sufficient correlations between 80-20’s 3 kinds of endorse-ments and the results in the rightmost column. 

     Pols maintained that the huge increasing in advantage for the Dem. pres. candidate up till Obama’s 2nd election is simply the trend of all immigrant communities. When refugee immigrants first came to the U.S., they always favored the Republican Presidential candidates, because the GOP candidates are more anti-communism. Examples are the cuban, the Korean and the Vietnamese voters. However, gradually the immigrants realized that Dem. Party provided more economic benefits to the immigrant community so they began to favor Dems. The pols maintain that the slight decrease for Kerry was simply fortuitous. When the big decrease for H. Clinton came out in 2016. The pols explained that immigrants were always more supportive of an incumbent president. Hence, H. Clinton’s is expected to enjoy a lesser margin of advantage than Obama’s 2nd election. 

     In 2020, however, Biden's margin of advantage from AsAm votes has shrunk to 20 points less than Obama's 2nd term. If there is another shrink of that size, AsAms may be reverting to favoring a Republican presidential candidate again. We hope that the Democratic pols will wake up and start urging Democratic presidential candidate to pay much more attention to the CLOUT of 80-20, which desires nothing more than equal opportunity for AsAms. Tips on when to apply to Harvard

Tips for Those AsAms Who Really Want to Attend Harvard

     We heard through the grapevine that this would be a good year for AsAms to apply to Harvard. Why? Because Harvard normally admits more AsAms under legal pressure. Next year, the Supreme Court will likely decide whether to accept the case of Student For Fair Admission vs. Harvard. Harvard wants to avoid that court trial. Hence, the legal pressure is at its highest.

    Read on to see proof that Harvard yields under legal pressure. Harvards' % enrollment of AsAms hovered around 17% for 2 decades, from 1991 to 2011, during which the population of Asians, aged 18 to 21, doubled. See below:
   However, in 2014, when Student For Fair Admission, SFFA, sued Harvard for discrimination against AsAms in Boston's District Court, its AsAm enrollment increased to 20%. In 2018, it further increased to 23%. In 2020 i.e. class of 2024, it increased "by 6% to 28.6%". Click here and scroll down to the paragraph entitled "Demographics" to verify that Harvards' class of 2024 increase to 28.6% AsAms.

    Let's reflect on the above info. Do the rapid increases in AsAm enrollment, during SFFA's law suits against Harvard, convince you that Harvard was clearly discriminating against AsAms during the 2 decades from1991 to 2011? Of course. Can you be sure that Harvard is not discriminating against us even today? Of course not, remembering that Harvard has a discriminatory personality rating in its "wholistic evaluation" of applicants?

    Do you now clearly understand what Harvard responds to? Yes, legal pressure!


Whom do we thank for Harvard's apparent improvement?

    Our thanks should go to SFFA which is led by Ed Blum, who is a friend of
80-20.
80-20, and therefore YOU, have supported Blum since 2012. 80-20 may even have played a role in inducing Ed Blum to sue Harvard for discrimination against AsAms. EF has donated $10,000 per year to SFFA for the last 4 years, although that amount is only a pittance compared with the millions of dollars of legal fees that Blum had raised to wage the legal battle against Harvard on behalf of AsAm youth.

    Don't relax. Think! Could Harvard back track, if the Supreme Court doesn't make a permanent ruling to stop discriminatory college admissions???

Build Trust with the DOJ

Careless Research or Fake News?

Recently some AsAm orgs. (NOTE: we are not naming names) have been circulating untruthful stories against DOJ's China Initiative.

They reported that Prof. Anming Hu's case was the first court trial under DOJ's "China Initiative", and yet the prosecution failed. They went on to
infer that China Initiative chased phantom crimes and therefore should be terminated.

The above claim is NOT true.

Prof. Hu's case was NOT the first case or the first academic case. Even Hu's lawyer agrees with 80-20. The DOJ has won cases under China initiative, including the 2019 case against Adjunct Prof. Yi-Chi Shih of UCLA who was tried and convicted.

There is another untruthful story about China Initiative - its sole purpose is to stop "economic espionage or trade secret theft". Click here to read the official definition of "China Initiative." It has 10 components, Its mission is quite broad.

Making Up Stories to Accuse the DOJ is Counter Productive

We hope that our fellow AsAm orgs. will agree with us that circulating unfair and untruthful stories about China Initiative will likely be counter productive. We need to build trust with the DOJ.

80-20 is far from wanting to kiss up to the DOJ. Please read letters from 80-20 President, S. B. Woo, to Attorney General Merrick Garland and to FBI Director Christopher Wray. In those letters, Woo pointed to DOJ agents' gross misconduct against Prof. Anming Hu. Indeed, he explicitly asked Director Wray to fire agent Kujtim Sadiku who lied and cheated to incriminate Prof. Hu.

80-20 hopes thats all AsAm orgs will be fair to the DOJ and build trust. Then and only then will the DOJ correct its excesses in its EXECUTION of "China Initiative".
