The Power of One - a salute to 80-20 supporters

   The following illustrates THE POWER OF ONE!
   80-20 is the ONE. Most other Asian Am national organizations are lined up on the other side on the college admission issue.
   Without 80-20, which opposes ALL those so called "civil rights" Asian Am. orgs., these articles in prestigious publications, shown below, would NOT have been written! With 80-20 speaking up for Asian American parents and children, the tide has changed! 7 articles in 4 weeks! These prestigious mainstream print media are speaking out in increasingly more firm condemnation of discrimination against us! See the titles of the 3 latest articles, shown in red!

   The power of one. 80-20 is the one!
   Almost all the articles compared the discrimination against Asian Ams to how the Ivies used to discriminate against Jewish Am students. That was the CENTRAL theme of 80-20's amicus brief to the Supreme Court.
   What are the lessons for us?
      i) "One man (or organization) in the right is a majority," and
      ii) God helps those who help themselves. Asian Ams DON'T HELP OURSELVES ENOUGH! So many Asian Am. "civil rights" orgs are for the the race-conscious college admission policy. Ridiculous? Scary?!
   Does 80-20 really enjoy the power of ONE? NO! 80-20 would much rather be just one org. in an UNITED Asian Am. community fighting for equal opportunity of Asian Am. adults and children and help make America a "more perfect Union." We urge our sister organizations to re 44d -think their past and work together.
   Which Asian Am civil rights orgs are still supporting the race conscious college admission? They are OCA, JACL, Asian Am. Legal Center of Los Angles, AAJC of Washington D.C. AALDEF of NY.
   80-20 has repeatedly reached out to them & requested joint examination of issues and UNITED action. We've NOT succeeded yet.

   The Brown Daily Herald reported Nov. 29 the surprising results of a poll that found "more than 58 percent of students oppose the University's consideration of race in student admissions decisions, while over 34 percent of students said they supported the policy."

   In a NY Times article which quoted 80-20's amicus brief to the Supreme Court, it also reported the following. The 8 Asian Am. students, shown below, who are attending the Univ. of Texas all disagree with their instructor in a political identity class. The students oppose using race as a preference for admission which the U. of TX practices.

NY Times Quotes 80-20's Amicus Brief

[A] Good News

   The article starts with the picture of 8 U. of TX students. They all disagreed with their instructor who supported the "race-conscious" college admission.

   Think hard now!

   Which Asian American organization has the ability to put YOU in the argument on big issues?

   In the SUPREME COURT, 80-20 EF's amicus brief advocating a "race-neutral" college admission has placed YOU in the argument!

   In the PRESIDENTIAL ELECTION, 80-20 PAC's advocacy for an Asian Am. bloc vote placed YOU in the argument, as reported in LA Times, CNN, Politico, and all other major TV channels for a delivered 74% bloc vote.

   Who BUT the 80-20 Initiative has the ability to PLACE YOU IN THE ARGUMENT i.e. MAKING YOU RELEVANT IN AMERICA!

[B] Bad News
   In the military court of INjustice, Sgt. Jeffery Hurst, who not only permitted his subordinates to racially and physically abuse Danny Chen, but also led in such abuses, was acquitted of all serious charges except for dereliction of duties. According to a news release from Fort Bragg:

   "Hurst was sentenced to reduction in rank to E4 and hard labor without confinement for 45 days by a panel of eight officer and enlisted members. The military judge for the Hurst court-martial was Col. David Robertson. The prosecution team consisted of Maj. Joshua Toman and Maj. Stephen Hernandez, and the defense team was civilian counsel Haytham Faraj and Capt. Jamie Gurtov."

   Asian Ams who STILL want to join the US Army are clearly placing their lives at risk, because those who want to abuse them can do so without due repercussion. What a shame for the US military!

   There are two more trials. 80-20 EF is contemplating further action when those two "trials" are done. What a shame!

A Must Read. Replacing 80-20 with 90-10?

   Blacks voted 93 to 7 for Obama twice, and had voted 90 to 10 for the Democratic presidential candidate for decades. However, it has a weakness - can't SWING.

   A 90-10 bloc vote is 33% more powerful than an 80-20 bloc vote. That is because a 80-20 bloc vote yields a (80% - 20%) or 60% margin of victory to the endorsed candidate, but a 90-10 bloc vote yields a (90%-10%) or an 80% margin of victory. This is a 20% point increase over the 60 points. Hence, it is a 20/60 or 33% increase in power in helping the endorsed candidate win.

   The following numerical examples illustrate the huge power of a 90-10 bloc vote.

Example 1: POWER of casting a 80-20 bloc vote
Two candidates run against each other in a political division, which for simplicity is assumed to have two constituent groups only. One group has 1 million votes (6.7%) and the other has 14 million votes (93.3%). Candidate A, a novice, courts the larger group. When the ballots are open, candidate A wins the larger community by the ratio of 52/48. The margin of difference is 4%. Since the larger group has 14 million votes, 4% of 14 million votes provides a winning margin of 560,000 votes to candidate A. His opponent, candidate B, is a seasoned politician. She courts the smaller group and wins that community by a ratio of 80 to 20. The difference between 80% and 20% is 60%. 60% of 1 million votes is 600,000 votes. As a result, candidate B wins the election by (600,000 – 560,000) or 40,000 votes. Astounding? Yes.

Example 2: THE INCREDIBLE POWER of a 90-10 bloc vote!
[Same basic story as above, except the smaller group now votes 90-10, and the size of the larger group is increased to 19 million votes.]

Two candidates run against each other in a political division, which for simplicity is assumed to have two constituent groups only. One group has 1 million votes (5% of total) and the other has 19 million votes (95%). Candidate A, a novice, courts the larger group. When the ballots are open, candidate A wins the larger community by the ratio of 52/48. The margin of difference is 4%. Since the larger group has 19 millions votes, 4% of 19 million votes provides a winning margin of 760,000 votes to candidate A. His opponent, candidate B, is a seasoned politician. She courts the smaller group and wins that community by a ratio of 90 to 10. The difference between 90% and 10% is 80%. 80% of 1 million votes is 800,000 votes. As a result, candidate B wins the election by (800,000 – 760,000) or 40,000 votes.

   Incredible?! A small minority of 5%* can be the kingmaker by voting 90-10!! Leading you to the water is 80-20's job.    :-) :-)

AsAm vote too SMALL to count in battle-gd. states?

          Is our vote too small to count in battleground states (BGSs)?
         Most people think so!
   THINK AGAIN! Here is what happened in some battleground states in the 2000 election.
Names of States    Margins of Victory    % AsAm Voters (Population)
  Florida                     0.0092%                        1.2% (2.4%)
  New Mexico              0.06%                            0.7% (1.4%)
  Wisconsin                 0.22%                            1.1% (2.3%)
  Iowa                        0.31%                            0.8% (1.7%)
  Oregon                    0.44%                            1.8% (3.7%)

   Note that the % of Asian American voters is normally about HALF that of our population. This is because only about 58% of the Asian Americans are citizens. In addition, ours is a young population & has a larger than normal % of people under 18 years of age, who cannot vote.
   Compare the columns of margins of victory versus the % of AsAm voters. In every case, our voter % is at least 2.5 TIMES larger than the margin of victory.
   Imagine when the two major parties know that they can count on Asian Ams to deliver a bloc vote, if & when 80-20 endorses its presidential candidate.
   Do you think that our adults will STILL face the lowest  glass ceiling in workplaces, AND our children STILL face the highest admission bars in applying to elite colleges? No way!
   80-20 Educational Foundation can lead you to the water, but we can't force you to drink it. We can provide you with the knowledge and how to make yourselves equal citizens. YOU must decide whether you want it.

Demand Justice for Danny Chen

       Did we forget Danny Chen's tragic death? NO!!

Danny Chen was American by birth AND by choice. He defied his 
parents' objection to join the Army. But he was RACIALLY & physically brutalized
to committing suicide by 8 of his superiors in his Company.

   Sgt Jeffrey T. Hurst will be tried from Nov. 5th to 9th. He is largely responsible for the suicide of Danny Chen. Our government's charge transcription states, "Hurst . . unlawfully killed . . Danny Chen . . by hazing and maltreating and negligently allowed (subordinates) to haze and maltreat .." 

   o Hurst, a sergeant, could have stopped his subordinates like Spc. Offut (6 months in jail & kicked out of the army) and Spc. Curtis (3 months in jail and reduction by 3 ranks from E-4 to E1) from abusing Danny.
   o Hurst not only didn't stop the E-4s from racially and physically abusing Danny Chen, he led both abuses. It is dereliction of duty, reckless endangerment, maltreatment of a subordinate, violation of of lawful general regulation, and negligent HOMICIDE.
   o Hurst led racial abuse by calling Danny "racially disparaging terms including "dragon lady," zipperhead," and "fortune cookie" or words to that effect." He also "negligently failed to prevent …Spc. Offutt and...Curtis from using ..terms including "Jackie Chen," "Fortune Cookie,"  . . "Soy Sauce," and "Dragon Lady," . . as it was his duty to do."
   o Hurst led the hazing of Danny Chen. He "unlawfully tied a sandbag to the wrist, or arm of … Danny Chen . . ." The above quoted paragraph was in the government's original charge sheet, but was dropped on April 23, 2012. However, the charge that "Hurst hazed Danny" still stands, except that it is not longer so explicit.
   o Quoting the government's charge sheet, "HURST . . negligently caused Private (E-2)Danny Chen to take his own life with a firearm, . . ." and "conduct likely to cause death or grievous bodily harm to Private (E-2) Danny Chen, . . "

   LOGIC & JUSTICE DEMAND that Hurst be penalized more than Spc. Offutt.
Hurst is higher in rank. He failed to stop the racial and physical tormenting of Danny Chen by Offutt and others. Indeed, Hurst led!

   Demand Justice! Our national se 4ce curity depends on a just court in the military system. Stay focused! Two more trials will be coming soon.

Post Supreme Court (SC) Oral Arguments Analysis

   Summary: The current "race-conscious" college admission policy remains, post SC oral arguments, in a very weak position. We are in good shape.

   Don't relax though. It's a long time between now and next June, when the SC will announce its decision. Be vigilant. Forward this e-newsletter to your friends.

(1) Thinking liberals are
        "Rethinking Affirmative Action"!

   This article, written post SC oral arguments, begins with:
"The founding principle of affirmative action was fairness."
Well said!

   The author then goes on to describe how the university community has over the years redirected AA to mean diversity. He points out that although Americans like diversity, we like fairness more. The university community has let "diversity trump fairness." Therefore, it may be time to rethink AA.

   He gave a superb illustration of how the Supreme Court Justices were upset by "diversity has trumped fairness."

   "In court on Wednesday, Justice Samuel A. Alito Jr. attacked the political underbelly of this system. The University of Texas argued that diversity within racial groups was also important, citing "the African-American or Hispanic child of successful professionals in Dallas." Skeptically, Justice Alito asked the university's lawyer, "They deserve a leg up against, let's say, an Asian or a white applicant whose parents are absolutely average?"

   "Justice Kennedy followed up by telling the lawyer, in one of the most quoted lines of the day, "So what you're saying is that what counts is race above all."

   Need I say more?

(2) Will the Asian Am organizations like AACJ, AALDEF, APALC begin to rethink?
   AACJ even tried to organize a demonstration before the Supreme Court to support "race-conscious" admission. See a video below.

   Did you chuckle? Did you then shake you head?

   Seriously, now, our nation needs a FAIR college admission that'll help qualified students of ALL races who for one reason or another can't get into manageably challenging schools. The current "race-conscious" admission will NOT cut it. It is, if anything, wasting many of the best African and Hispanics students in STEM & law fields and is particularly unfair to Asian Am students. It should be replaced!

    In 2 days, the Supreme Court (SC) will hear oral arguments on "race-conscious" college admission. A lot of related good news popped up recently.
   To sense how things have apparently been turned around, read the following quotes:

An EPOCH Changing Article in Atlantic?

   Asian Ams are urged to read this article and pass it around, especially to your elected officials. http://www.theatlantic.com/business/archive/2012/10/the-secret-to-us-growth-in-the-21st-century-more-asians/263161/ . It was published in The Atlantic by Noah Smith on Oct. 2, 2012. It may have an epoch changing impact on America.
   The article first states, " . . America was the 'Alternative Europe' . . . Political and religious dissidents who were dissatisfied with the ruling regimes in their homelands, oppressed ethnic minorities, and poor people who couldn't get a good job -- all made their way to the United States. . . American benefited greatly from that inflow, . . " The author called it the ALT-Europe period of America.
   It then advocates that for America to continue to grow, it needs an ALT- Asia period.
   The article's last subtitle is "50 Million More, Please." "Asians want to come to America. According to the most recent Gallup survey, the United States is the desired destination for 22 million Chinese people, 10 million Indians, 8 million Bangladeshis, 5 million Filipinos, and 3 million people from Vietnam. These are the kind of numbers we need to keep our economy young and growing."
   It ends by stating: "This, then, is the "Alternative Asia Plan." America began as a nation of Europeans and Africans; it is now a nation of Europeans, Africans, and Latin Americans. It must become a nation of Asians as well. Failing to do this would mean shutting ourselves off from the master narrative of the 21st Century."
   The above is consistent with what futurist John Naisbitt predicted in his 1996 book "Megatrends Asia":
   "The pivotal players in the new global configuration of East and West will be Asians living in America and Asians born in America. It is in America where East and West truly meet."

Winning "Race Neutral" fight for YOU?

   On October 10, the U.S. Supreme Court will hear oral arguments over the "race-conscious" admission policies. 80-20 EF's entry into this battle was commonly recognized as a major element helpful towards possibly upending the "race-conscious" admission. The petitioner's main brief mentioned "Asian Ams 22 times." The Supreme Court is expected to announce its decision next June.
   Will 80-20 EF win the battle for you? It's a huge and very difficult battle. We are only 5.5% of our nation's population. 80-20 EF is trying valiantly.
      

       Veteran education reporter Scott Jaschik, who was the editor of the Chronicle of Higher Education from 1999 to 2003, was interviewed by New America Media.
      
New America Media: How will this decision affect college admissions policies throughout the country?
Scott Jaschik: I think this will have a large impact in different ways.
There are places like the University of Texas, other flagship universities
and also elite private universities that consider race in admissions. These
institutions are very hard to get into, places that typically make their
admissions decisions based - in large part - on test scores and course
grades. On average - and it's very important to say on average because
there are exceptions to this - if they eliminated the consideration of race,
most of these institutions would admit fewer black, Latino, and Native
American students. Many of them might see an increase in Asian-American
students.*
In fact, when affirmative action was eliminated in California,
there were initial spikes in Asian-American enrollments more so than
white enrollments.
So, first of all, the decision will be important for the highly competitive
admission institutions, but it [may have] other impacts. It could well affect
the way many colleges, and not just the elite institutions, administer
financial aid or how their summer programs operate.
*NOTE: 80-20's purpose in the Supreme Court fight is to ELIMINATE THE DISCRIMINATION against Asian Am applicants in college admissions. It is NOT to increase the no. of AsAm students in elite colleges, although that may come as a result of our winning the case. Indeed, S. B.'s personal view is that an education from elite colleges is helpful towards advancing AsAm graduates' careers only, not necessarily their value system. He said, "I hope we'll see more AsAm IVY graduates fighting for equal opportunity for our weak & powerless Asian Am community."
NAM: What's your sense of where court is headed?
Jaschik: Most experts think the current court isn't generally sympathetic
to affirmative action. The court could scale affirmative* ("race-conscious" admission) back partially or fully. You really don't know until the decision comes out. Even then, if it's a decision that drives a major change in current policies and the colleges start to adjust accordingly, there will probably be more lawsuits and court decisions. I think the ramifications of this decision could be
quite dramatic over a period of time.
*NOTE: "Race-conscious" admission is only a small part of the affirmative action. Indeed, the so-called affirmative action in college admission is actually ANTI-affirmative, so far as Asian Ams are concerned. Recall that Asian Ams need to score 140 points higher than whites to have an equal chance to enter elite colleges. We believe Mr. Jaschik is talking about "race-conscious" college admission only.

Good, Neutral & Bad News

[A] Good News - 80-20EF's Work Recognized Internationally
   Reuters International published a long article on the US "race-conscious" college admission issue. It recognizes 80-20's importance in speaking up for Asian Americans. See a few quotes:
o  "Fisher's main brief . . . mentions Asian-Americans 22 times and argues that they are victims of a race-based system that favors blacks & Hispanics. "
o  " Edward Blum, . . the principal architect behind the University of Texas lawsuit. He said Asian-Americans will likely remain front and center in the case. "An empirical case can be made that the group that has suffered the most from racial preferences (in the affirmative action era) has been Asians," Blum said."
o  " a nonprofit called the 80-20 National Education Foundation, ...decided for the first time to oppose race-conscious admissions. . . . 80-20 enlisted … (3 of the largest Indian Am. orgs and a Jewish group) to sign onto an amicus brief."

[B ]Neutral News - Pres. Obama endorsed by 80-20 PAC
   The political establishments in both political parties are beginning to discount 80-20 PAC. To reverse that, we need to
       o  be more willing to sacrifice self for the good of the whole,
       o  be better doers.
   Otherwise, the precious GROUP political clout which we won through so many tough fights, will fade away. Good luck with the endorsement.
[C] Bad News - Injustice in our Military Justice System
   5 of the 8 soldier who racially and physically tormented Danny Chen to death have now being tried & sentenced:
1. Sgt. Holcomb: One month in jail, no pay for that month, reduction by 1 rank. Outrageous!
2. Spc. Offutt: Bad conduct discharge (losing most veteren benefits), 6 months in jail, reduction by 3 ranks to E1;
3. Staff Sgt. Dugas: 3 months in jail (all commuted by the military judge. A mockery of justice! ), reduction by 1 rank; 
4. Sgt. Carden: 1 month in jail, no pay during that month, reduction by 1 rank
5. Spc. Curtis: 3 months in Jail, reduction by 3 ranks to E1 (Why should such a cruel person be kept in the service?)
   We appreciate the valiant effort of Maj. Toman to uphold justice. However, many of the military judges don't seem to know what justice is. They harmed the military justice system, the Army & our nation.
   3 more trials to go. Lt. General Daniel B. Allyn, commander of the XVIII Airborne Corps is yet to decide the final sentence for each of 8 culprits. After that, 80-20 will recommend how we TOGETHER will react to this outrageously tragic episode.

Will there be justice this coming Monday?

Danny Chen was American by birth AND by choice. He defied his 
parents' objection to join the Army. But he was RACIALLY & physically brutalized to committing suicide by 8 of his fellow soldiers who were his superiors.

o  First trial:  Sgt. Holcomb got one month in jail, $1,155 in fines & reduction by 1 rank. What a travesty of justice!

o  3rd trial:  Staff Sgt. Dugas got a demotion by one rank & 3 months in jail but actually he does NOT need to spend a day in jail through a weird charade in military justice. An insult to ALL Asian Ams, and a great dis-service to America!

Spc. Thomas Curtis IV will be on trial* from this coming Monday to Wed. in Fort Bragg.
   Here is what Spc. Curtis did to Danny Chen, according to our government's "Charge Sheet," which led to Danny Chen's suicide.
   "wrongfully addressing private (E-2) Danny Chen using racially disparaging terms "dragon lady," "Jackie Chen," "chink," "gook," "fortune Cookie," "slants," "egg roll," and "zipper head" or words to that effect."
   "did maltreat Private (E2) Danny Chen, a person subject to his orders, by ordering Private Chen to place his back against a wall and bend his knees in a ninety (90) degree angle to simulate sitting in a chair while Spc. Curtis struck Chen in the thigh with his knee."
   "did maltreat Chen, a person subject to his orders, by throwing rocks at Chen."
   "did maltreat Chen . . . by kicking Chen on the side of his torso. "
   "did maltreat Chen . . . by grabbing Chen by the plate carrier vest and helmet worn by Chen and dragging him across the ground."
   "did, . . unlawfully kill Private Chen, by hazing and maltreating Chen and, through this conduct, negligently caused Chen to take his own live with a firearm, . . ."
   "did, wrongfully and wantonly engaged in conduct, to wit: he hazed and maltreated Chen, conduct likely to cause death or grievous bodily harm to Chen, . . ."
   Will there be justice? Will there be "A Few Good Men/Women" in America's military justice system?
   As a former politician, I have thick skin. However, in this case I feel personally insulted.   Do YOU?   You decide if your offspring's destiny is somewhat tied to this case!!!

Such INJUSTICE In Our Military JUSTICE System

Danny Chen was American by birth AND by choice. He defied his

[A] INJUSTICE ONE
   On 7/25/2012, Sgt. Adam Holcomb was convicted by a jury of peers of maltreatment of a subordinate and assault consummated by battery. Maj. Bret Batdorff, the presiding judge, sentenced Holcomb to 30 days in prison, a demotion and a fine of $1,160.
   See how Sgt. Holcomb abused Danny Chen, who committed suicide! Below are quotes from the government's "Charge Sheet" & trial testimony:
o  "addressing . . Danny Chen using racially disparaging terms including "Dragon Lady" or words to that effect." "Holcomb uttered some slurs over the radio, where they were heard by the entire platoon, adding to Chen's humiliation." - court testimony, LA Times.
o  "negligently failed to prevent Specialist Ryan J. Offutt and Specialist Thomas P. Curtis from addressing Private (E-2) Danny Chen using racially disparaging terms including "dragon lady," "Jackie Chen," "chink," "gook," "fortune cookie," "slants," "egg roll," and "zipper head," or words to that effect as it was his duty to do."
o  "by grabbing Private (E-2) Danny Chen by his wrist, pulling him out of his bed, & dragging him over the tent floor and a gravel path." The dragging "bloodied Danny Chen's back." - court testimony, NY Times.
o   Military laws: "Wrongful abuse of a public animal," will result in a max of 3 months in jail or 3 months' pay cut. Visit

[B] INJUSTICE TWO
o   Staff Sgt. Blaine Dugas was convicted of dereliction of duty in the hazing-related suicide of Pvt. Danny Chen. That is for letting his Sgts. and Spcs. racially and physically abuse Chen to death.
o   Col. James E. Hardin sentenced Dugas to 3 months in jail and demotion by one rank. Fair? NO!
o   Dugas does NOT need to spend a day in jail, because Col. Hardin considered limitations placed on Dugas during the investigation period sufficient punishment to be equivalent to having served 3 months in jail. Does the colonel have any empathy for Danny Chen, his family and millions of Asian Americans who are trying to decide if we rank higher than "public animals" in the eyes of the military "justice" system? The military tries to make it sound like Dugas was actually in jail. He was not! In contract, Spc. Offutt was given 7 days of reprieve only for the same limitations during the investigation period.
   Staff Sgt. Dugas will NOT spend a single day in jail. Outrageous injustice!
   When soldiers who are guilty of abusing a follow soldier to death are NOT punished, no amount of training program will be effective. Does our government care for effective Armed Services any more?
   How can we achieve justice? When YOU personally Wake UP/speak UP/stand UP by either giving time or money or both. You do NOT need to donate time/dollar to us. OCA -NY is also fighting for this issue. You must make a personal commitment to achieve justice.

Is an Asian Am less than a dog?


Danny Chen was American by birth AND by choice.
He defied his 
parents' objection to join the Army. But he was RACIALLY brutalized 
to committing suicide by 8 of his fellow American soldiers who were his superiors. You will soon see why I asked: "Is an Asian Am less than a dog?"
   Will there be Justice? 3 of the 8 culprits have been tried.
o  First trial:  Sgt. Holcomb got one month in jail, about $1,100 in fines & reduction by 1 rank. What a travesty of justice*!
o  2nd trial:  Spc. Offutt got 6 months in jail, reduction by 3 ranks to E1, and a "bad conduct discharge."
o  3rd trial:  Staff Sgt. Dugas, who unlike Holcomb & Offutt who have racially and physically abused Danny Chen, got 3 months & a demotion by one rank because he didn't stop the abuse.
   The NEXT TRIAL WILL TELL if there will be JUSTICE. Spc. Thomas Curtis IV will be tried in 7 days, from Aug. 27 to 31.
   According to our government's "Charge Sheet," Curtis had in those 6 weeks, from the day of Danny's arrival at the outpost to the time of his suicide,
   "wrongfully addressing private (E-2) Danny Chen using racially disparaging terms "dragon lady," "Jackie Chen," "chink," "gook," "fortune Cookie," "slants," "egg roll," and "zipper head" or words to that effect."

   If a dog is treated that way by Spc. Curtis -- kicking the dog's torso, throwing rocks at it, kicking the dog's thigh with his knee and grabbing the dog by its collar across the ground -- the National Humane Society, NHS, will be up in arms.
   When NHS finds out that many dogs are treated that way in the Army, it will start a demonstration outside the Pentagon. National TV, the NY Times, Washington Post and LA Times will prominently report the news. Decent Americans will be calling their Congressmen to complain "How terrible!" Spc. Curtis will be kicked out of the Army for bad conduct. A top Army general will apologize & promise that it shall never happen again.
   But when an Asian Am patriot is treated that way to the point of committing suicide, do we hear from national human rights organizations?
   Silence! Just a terrifying silence!

    Notes on Fort Bragg trials - racism v. justice in Danny's death (III)
Danny Chen was American by birth AND by choice. He defied his 
parents' objection to join the Army. But he was RACIALLY brutalized 
to committing suicide by 8 of his fellow American soldiers who were his 
superiors. The first culprit, who racially & physically abused Danny, got a slap on the wrist. Outrageous!

To reverse that terrible setback to justice, S. B. Woo* and Diana Ting flew to Fort Bragg to attend the second trial. The second culprit got 6 months in
jail, discharge from the Army and a reduction by 3 ranks to E-1. Justice achieved? Too soon to conclude! There are 6 more trials to go; all existing sentences are subject to appeals and the final decision by the Commander of the XVIII Airborne Corps. Do your share to mobilize our community. Pray for Justice but expect the worse. Woo & Ting have returned to their respective homes.
   Staff Sgt. Blaine Dugas, Jr. is on trial today. He is charged with wrongfully consuming alcohol and permitting his subordinates, who are sergeants and specialists, to racially and physically abuse Private Danny Chen to the point of committing suicide. He also lied. He denied that other non-commissioned officers reported to him that Danny Chen was being being abused.
   Dugas has pleaded guilty to drinking and has hired a civilian lawyer to defend him together with a government defender who is a major. The prosecution team will again be headed by Maj. Joshua Toman & assisted by Capts. Sasha Rutizer and Stewart Hyderkhan. Maj. Toman also headed the prosecution team in the 2nd trial. He was the only one in the second trial who seemed to recognize that Private Danny Chen was a human being, not a worm nor a piece of court evidence in the trial. Col. James E. Hardin will be the new judge.
   Pray and work for JUSTICE.  TOGETHER, we shall overcome.

         Notes from Fort Bragg -- racism v. justice in Danny Chen's death (II)
Danny Chen was American by birth AND by choice. He defied his 
parents' objection to join the Army. But he was RACIALLY brutalized 
to committing suicide by his fellow American soldiers who were his 
superiors. The first culprit got a slap on the wrist. Outrageous! S. B. Woo* and Diana Ting were staying at Fort Bragg, attending the second trial. They are reporting to you here. Will they be seeing justice or racism or something in between?
   Together, we took a stand. Together, we made progress! Together, we RECOVERED from a 100 to  10 beating in Sergeant Holcomb's trial.
   Justice achieved? No! Just a beginning!
 6 more trials to go
 the sentence for Offutt can be reduced upon appeal  
 the final sentencing for Holcomb, the guy who got a slap on the wrist, is still in the hands of Lt. General Daniel B. Allyn of the XVIII Airborne Corps.
   On 8/13/12, my birthday, Specialist Ryan Offutt was sentenced to
1.   6 months in jail, and
2.   Reduction in rank from specialist (E-4) to Private (E-1). (Economic implication: Offutt's pay while in jail will be that of an E-1)
3.   Bad Conduct Discharge (considered a relative severe punishment, because it is a career-ending punishment for a professional soldier. It has many economic implications including no veterans benefits after the discharge.)
   In comparison, Sergeant Adam Holcomb, who is perhaps the most guilty, received only:
1.  1 month in jail
2.   Reduction by 1 rank, and
3.   fined $1181.55.      He was NOT even kicked out of the Army.
   There are aspects of "Justice for Danny Chen" that are NOT even touched by the military justice. Read the following carefully. New York Times reported, "Private Chen also revealed that he had witnessed noncommissioned officers shooting unarmed civilians, Private Johnson testified. The claim has apparently been scrutinized by military investigators. Neither the prosecution nor the defense asked follow-up questions about this revelation, suggesting that the court had imposed limits on its admissibility."
   If you still don't understand the significance of the above, PLEASE go view the movie "A Few Good Men," starring Tom Cruise & Demi Moore. You'll begin to know something about the military justice system.
   Finally, the tactics used in the trial were disconcerting.  While the defense called upon five witnesses to build up the human elements of Specialist Offutt, with the intention to lessen the punishment, the prosecution emphasized how Danny Chen suffered excessive & abusive punishment without real military purpose.  However, there was no counter to the defense's claims that Offutt had a life to lead — Private Danny Chen, another human being, wasn't even allowed to begin his life due to the actions of his superiors.
   Danny was like a prop, ignoring the human element haunting the entire trial. Finally, we salute Major Joshua M. Toman, a good man who is also the leader in the Prosecution team, for his excellent summary statement pointing out how dehumanizing Offutt's abuse of Danny Chen was.
   Diana and I will go home now. "Notes from Fort Bragg" will continue, but no longer be daily.   Staff Sgt. Blaine Dugas' trial will be next, beginning this coming Thursday.    Pray and work for JUSTICE.

   Woo* & Ting* will be at Fort Bragg (FB) for the duration of the trial for 5 days.

   One supporter by the first name of Priscilla emailed, " You are very brave and I'm praying for your courage." To which SB replied, " 'There is nothing to fear except fear itself.' - Franklin D Roosevelt "
   Our morale was boosted. An email from Charles Zhang of Michigan, who has donated more than 30,000 to 80-20, stated, "My son Mitchell (a high school student) said if you needed, he would fly over to attend the trial with you and help Diana . . . . My wife Lynn can come over with him. I have a big client event I have to attend on the 14th, after which I can join you guys." They are role models. We need that spirit.
   More people from Fort Bragg area are volunteering to attend the trial to support.
   To get into the Court: Any citizen with a state-issued photo I.D. e.g a driver's license. When: Any time when you arrive.
   Are Danny Chen & Harry Lew's suicides isolated event? No! It seems widespread. See following messages. Their names & e-addresses are withheld by Woo.
     (1) "I served in 2 Combat theaters in 1965 and had PTSD. But my Post Traumatic Stress Disorder was not from Santo Domingo or Vietnam. It was from discrimination and harassment by my First Sergeant in the 73rd Transport Co, US Army Fort Eustis, Virginia. This was due to my being Asian American, an ABC, . . . "
     (2) "As an AsAm who served in U.S. Marine Corps, I witnessed a lot of racial discriminations against Asians. . . . a Staff Sgt. on stage was asking fellow Marines to "tell a Chinese joke." . . . the most derogatory, dehumanizing racist, sexist joke was told on the stage, while several hundreds of Marine in the audiences just laughed. None of the high rank officers on the scene stepped up to stop this kind of racial harassment. One of my buddy (Caucasian) next me said "You should say something." I regret not standing up and shouting back . . . They should at the minimum be expelled from the Army and sentenced to 2nd degree manslaughter. Shame on . . . "

Woo will attend Fort Bragg Trial; OCA-NY holds Rally

   S. B. Woo will be attending the next trial in Fort Bragg, NC relating to Danny Chen's suicide owing to racial hazing. Spc. Ryan Offutt will be tried* from Aug. 13 to 17. Woo'll be assisted by Diana Ting. They will write their reports to you daily. Look out for these e-newsletters.
   Those who live nearby Fort Bragg are urged to show up at the Fort Bragg Court House. Demonstrate your concern, before it's too late. You owe it to yourself and your children. Whichever ethnic component of the AsAm community you belong to, SHOW UP! Remember that Vincent Chin, a Chinese Am., was killed by people who took him to be a Japanese?
   One day when your grandchild asks, "Grand Pa, you live so close to Fort Bragg. When the famous Fort Bragg trials was going on, did you symbolically show your concern by appearing at the trial once? Yes? Thank you!"
   What could have caused such a shockingly lenient sentence on the 
culprit, who racially brutalized Danny Chen, in the first trial? 
Does anyone think that Sergeant Holcomb deserves to stay in the Army?
   A military jury and the presiding judge heard an African Am soldier's testimony: he too was abused by Sgt. Holcomb. That soldier also thought about committing suicide due to hazing.

   Sergeant Holcomb admitted in court that he was "suffering from symptoms that resembled post-traumatic stress disorder after three deployments to war zones." He said he had not had a brain scan, but added, "I know there's issues up there."    Why was Holcomb permitted to stay in the Army? Was it 
outright racism in the US Army? Was the defense exceptionally capable? Was the presiding judge fair??????????

Racism Against Asian Ams in the US Army


   Danny Chen was American by birth AND by choice. He defied his parents' objection to join the Army. But he was racially brutalized to committing suicide by his fellow American soldiers who were his superiors. Even worse, the military system chose to condone the outrageous evil against Danny Chen. See below.
   The trial against the first of the 8 culprits was over. Sergeant Holcomb was sentenced to a reduction in rank, a fine of $1181.55, and 30 days in jail. The other seven will likely get even less, because they had less charges against them than Holcomb.
 Do you know enough about the Danny Chen tragedy? If not, read the following quotes from an editorial and articles of NY Times, and other reputable prints. Otherwise skip all the quotes and get to the central message near the bottom.

 o   "He was dragged out of bed, pelted with rocks and racial taunts and forced to crawl along the ground and do pull-ups without swallowing or spitting out a mouthful of water — all apparently because he forgot to turn off the water heater after taking a shower. Private Chen was the son of Chinese immigrants in Manhattan, and he had written to his parents about being the butt of racial jokes."

Private Chen was ordered to complete excessive exercises almost immediately upon arriving in Afghanistan last August. Although he had successfully completed both basic and advanced training in the US before deployment, members of his platoon claimed he was not physically fit. Pvt. Chen, the only Chinese-American in his platoon, was required to run excessive sprints, carry sandbags, subjected to barrages of rocks (supposedly to simulate artillery) and was assigned extra duties."

 o   Such punishments resemble the "smokings" that drill sergeants mete out at basic training to correct mistakes. But, in Chen's case, it wasn't long before this campaign of "corrective training" escalated into sheer brutality.

   Since Danny was given extra duty and punishment almost from day one, we suspect the following:

   We suspect that Danny Chen's superiors didn't trust the loyalty of a Chinese-American -- based on racism -- from day one, and therefore for their own security worries, wanted to drive him off the unit.

   Anyone can be driven to mental and physical exhaustion and begin to fall down on his/her job. Once the signs of a "weak" soldier appear, then his superiors are justified to apply even more brutal abuse. This methodology can be applied against any Asian American with impunity in the current US Army, be they American soldiers of Chinese, Pakistan, Korean or Iranian origin.
   We urge all good people to help dig into this matter to either prove or refute our suspicion. If indeed that is the case, and the Army condones it, is this what America is all about?
 Help us. We look for "A Few Good Men" in the Army's legal system, and in this great land.
   We need to mobilize our entire Asian Am. community to become a "David" to face a giant -- those who condone racism in the US Army.
